SALE TERMS & CONDITIONS
Bidding.
All lots will be sold to the highest bidder, unless sale is cancelled by sale management. The Auctioneer will settle any disputes with regards to bids and his decision will be final.
Announcements.
Corrections or additions of any information in the sale catalog will be announced on the internet site and will take precedence over any printed material. It is the responsibility of the seller to provide the sale management with any corrections prior to the sale.
Payment Terms.
Terms of the sale are cash or check payable to Heritage Cattle in full to sale clerk immediately following the sale. Cattle will not be released until payment is made, unless prior arrangements are made with sale management.
The sale terms and conditions constitute a contract between the buyer and Heritage Cattle and are equally binding upon both parties. The rights and obligations herein are not transferrable or assignable.
UNLESS OTHERWISE EXPRESSLY STATED IN THESE SALE TERMS AND CONDITIONS OR ANY OTHER WRITTEN AGREEMENT BETWEEN THE PARTIES RELATING TO THE SALE, HERITAGE CATTLE MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, EVEN IF SUCH PURPOSE IS KNOWN TO THE PARTIES. THE REMEDIES PROVIDED IN THESE SALE TERMS ARE THE EXCLUSIVE REMEDIES OF THE BUYER, OR ANY PARTY CLAIMING THROUGH THE BUYER, AND UNDER NO CIRCUMSTANCES WILL THE SELLER BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES UNDER ANY INDEMNITY PROVISION OR OTHERWISE.
Registration and Transfer.
Transfer of animal ownership will be the responsibility of Heritage Cattle Company and will be done at the expense of seller only after clearance of all checks. Transfers should be completed within 2 weeks of sale date. Cattle for Export. All cattle sold for export must be paid in full immediately following the sale. Seller will supply all necessary health testing required for export to the buyer’s specific country. The buyer must arrange for the care of the animals until proper health papers can be completed. Breeding Guarantee. Heritage Cattle guarantees that all animals are breeders, with the exception of a) animals exhibited at any livestock show after the sale has occurred; b) animals who suffer injury or disease following the sale; c) animals subjected to negligence by or willful misconduct on the part of the buyer; and d) bulls that have semen collected prior to having the opportunity to breed females naturally. Bulls are not sold with a semen collection or freezing guarantee. We make no further guarantees, including the ability of any animal to compete in livestock shows, disposition, and length of life or production. Buyers must notify Heritage of any breeding issue by May 15, 2024. Heritage has the right to evaluate and determine if the bull is a breeder for a period of 6 months.
If the bull is a non-breeder, Heritage may offer a replacement or a sale credit for future purchase, but no cash refund is available. The sale terms and conditions constitute a contract between the buyer and Heritage Cattle and are equally binding upon both parties. Term Interest Heifers.
Purchaser must enter into a separate contract outlining full terms and conditions of ownership, copy is available for review prior to purchase. Failure to sign and agree to separate contract will result in cancellation of any sale. Selling a 50% Term Breeding Interest, the interest expires on February 1, 2028. The Interest includes no more than 2 IVF aspirations per year for a total of 6 for Buyer, and Buyer has option to sell aspirations or embryos. Heritage maintains possession of the female and all natural calves. Term Interest Bulls. Purchaser must enter into a separate contract outlining full terms and conditions of ownership, copy is available for review prior to purchase. Failure to sign and agree to separate contract will result in cancellation of any sale. Selling a 50% Interest, the interest expires on February 1, 2030 Semen Reservation. If noted, Seller is reserving the right to 150 units of semen if sold in the United States. Seller shall pay for collection and storage costs, and Buyer shall cooperate with release of AI Certificates as needed to accompany the units of semen. Further terms will be included in the final sale contract. IVF Flushes. Selling one IVF aspiration, guaranteeing six transferable embryos if conventional semen is used. Buyer must supply semen and is responsible for all costs of flush, transfer, and semen. Seller will transport cow for flush. Aspiration must be taken before May 1, 2024. Donor Prospects. Seller reserves two IVF flushes, at the option of Seller, on all Donor Prospects if sold in the United States. Any flush will not occur until after a heifer’s first natural calf. Expenses for the flush will be paid by Seller. Bred Cows.
Seller reserves two IVF flushes, at the option and expense of Seller, on all Bred Cows if sold in the United States. Seller guarantees the cow is bred at the time of sale but makes no guarantee as to birth of a live calf nor the quality or survivability of a calf born to the cow. Seller will provide necessary certificate releases for registration of the calf upon transfer of registration of the cow. Heritage makes no warranty or guarantee as to the quality of any particular animal nor any warranty or guarantee as to the results from exhibiting the animal at a livestock show

This Sale will feature the Best Cattle Sales “All Bids In – All Lots Sold” or a modified “Horse Race” style closing format.
The sale starts to close at 6:55 PM on closing day as it takes 5 minutes of no bidding on ANY lot for the sale to close. If there is no bidding between 6:55 PM and 7 PM on closing day the sale will close. If there is a bid on ANY lot the sale remains open UNTIL all bidding activity ends. Every time there is a bid the clock resets and another 5 minutes is added to closing time. It is suggested to all bidders to watch your lots until the sale is completely closed.
Example 1: Auction closes at 7:00 PM. There is no bidding from 6:55 PM to 7:00 PM. All lots are declared closed and the sale ends at 7:00 PM.
Example 2: Auction closes at 7:00 PM. There is a bid placed at 6:56 PM and countdown clock resets to 5 minutes. Auction is extended. No more bidding occurs. All lots are declared closed and the sale ends at 7:01 PM.
Example 3: Auction closes at 7:00 PM. There is a bid placed at 6:57 PM and countdown clock resets to 5 minutes. Auction is extended until 7:02 PM. Another bid is placed at 7:00 PM. Another bid is placed at 7:04 PM. Another bid is placed at 7:08 PM and countdown clock resets to 5 minutes. Auction is extended. No more bids are placed. All lots are declared closed.

HERITAGE CATTLE CO. ONLINE SALE
The first thing you need to do is make sure you are signed up to bid. If you have never signed up you will need to sign up on our Sign Up Page. On the Sign Up Page you will be asked to create an account. See the below image for an example of the form.
You will also be asked to create a username and password. You MUST have a valid email address in order to register. Remember to hit SUBMIT at the end.
You are almost finished and ready to REGISTER for the sale! Simply check your email and activate you account. Once you click on the verification of your email you will see this screen.
If you do not see the above screen then you should see this screen and you can request for the verification email to be resent.
If you do not get the verification email please check your spam folder or contact Victoria Lambert at 713-806-3998 for assistance or send us an email and we will help get your email verified.
Once you are signed into your account you will need to register for the sale. On the home page of Best Cattle Sales look in the drop down for the category/ name of the sale. Remember – You MUST be signed into your account in order to REGISTER. Look for the RED button that says Register For Auction. You will only need to REGISTER one time.
