This Sale will feature the Best Cattle Sales “All Bids In – All Lots Sold” or a modified “Horse Race” style closing format.

The sale starts to close at 6:55 PM on closing day as it takes 5 minutes of no bidding on ANY lot for the sale to close. If there is no bidding between 6:55 PM and 7 PM on closing day the sale will close. If there is a bid on ANY lot the sale remains open UNTIL all bidding activity ends. Every time there is a bid the clock resets and another 5 minutes is added to closing time. It is suggested to all bidders to watch your lots until the sale is completely closed.

Example 1: Auction closes at 7:00 PM. There is no bidding from 6:55 PM to 7:00 PM. All lots are declared closed and the sale ends at 7:00 PM.

Example 2: Auction closes at 7:00 PM. There is a bid placed at 6:56 PM and countdown clock resets to 5 minutes. Auction is extended. No more bidding occurs. All lots are declared closed and the sale ends at 7:01 PM.

Example 3: Auction closes at 7:00 PM. There is a bid placed at 6:57 PM and countdown clock resets to 5 minutes. Auction is extended until 7:02 PM. Another bid is placed at 7:00 PM. Another bid is placed at 7:04 PM. Another bid is placed at 7:08 PM and countdown clock resets to 5 minutes. Auction is extended. No more bids are placed. All lots are declared closed.

SALE TERMS & CONDITIONS
The following terms and conditions apply to all cattle and frozen genetics consigned by Herzog Cattle to the 2026 Dare to be Different Vol 7 Sale:

All cattle and frozen genetics must be paid for by check, cashier’s check, or cash prior to loadout of cattle or release of frozen genetics, unless payment arrangements have been approved in writing by sale management prior to release.

Cattle and frozen genetics will not be released from the sale premises until payment has been received in full, unless otherwise approved in writing by sale management.

All balances are due in full no later than fifteen (15) days following the conclusion of the sale. Any unpaid balance remaining after fifteen (15) days will accrue interest at a rate of eighteen percent (18%) per annum, beginning on the sixteenth (16th) day following the sale, to the extent permitted by applicable law.

Upon receipt of full payment, the seller will transfer the applicable registration papers to the buyer as soon as reasonably practicable.

If full payment is not received within thirty (30) days following the conclusion of the sale, the seller may, upon written or electronic notice to the buyer, retain ownership of the animal or genetics and exercise all rights of ownership, including the right to resell the animal or genetics to another buyer. The buyer shall remain responsible for any unpaid balance, interest, costs, and other amounts owed, to the extent permitted by applicable law.

FEEDING TERMS: Cattle will be provided care at no charge through seven (7) days following the sale. Beginning on the eighth (8th) day following the sale, feed and care will be billed at $20 per head per day for cattle remaining in the show barn.

These charges are intended to cover the seller’s costs and are not intended as a profit-making charge. Any veterinary, medical, or other extraordinary expenses incurred on behalf of the cattle will be billed to the buyer monthly.

All feed, care, veterinary, and other applicable charges must be paid in full prior to or at the time the cattle are picked up.

BREEDING INTEREST: Herzog Cattle reserves the right to conduct up to two (2) successful IVF flushes on each female offered in the 2026 Dare to be Different Vol 7 Sale. Such IVF flushes may be conducted after the female has completed her show career and at a time reasonably convenient for the buyer and seller. All expenses associated with the IVF flushes, including applicable veterinary, reproductive, collection, and related expenses, shall be paid by Herzog Cattle.

Herzog Cattle will coordinate the timing and reproductive arrangements with the buyer and will make reasonable efforts to minimize disruption to the buyer’s breeding program.

For purposes of this provision, a “successful IVF flush” means an IVF collection resulting in embryos suitable for freezing or transfer as determined by the attending reproductive veterinarian or IVF facility. If an attempted flush is unsuccessful, Herzog Cattle may make another attempt until two (2) successful IVF flushes have been completed, subject to the terms above.

CATTLE VIEWING: The sale offering will be available for viewing at Herzog Cattle in Chilton, Texas, beginning approximately three (3) weeks prior to the sale. Visits are by appointment only and must be arranged through sale management.

EXPORT: Products, cattle, and frozen genetics sold for export from the United States must comply with applicable U.S. export laws and regulations and the import requirements of the destination country. Diversion of products, cattle, or genetics contrary to applicable U.S. law is prohibited.

Cattle sold for export may be required to undergo additional testing, inspection, certification, or other procedures after the sale and prior to export. All such testing, inspection, certification, transportation, and related costs shall be the responsibility of the purchaser unless otherwise agreed in writing.

Buyers are responsible for determining and satisfying all applicable requirements for importation into the destination country.

CONDITION OF SALE: Except as expressly stated in these terms and conditions or otherwise provided in a written agreement signed by the seller, all cattle and frozen genetics are sold “AS IS,” without warranties or guarantees, express or implied, including any warranty regarding health, fitness for a particular purpose, breeding performance, reproductive performance, or suitability for international export.

Bulls offered in the sale will have fertility examinations performed by a licensed veterinarian, before they leave the sale location.Such examination does not constitute a guarantee of future fertility or breeding performance.

BIDDING: Each sale offering will be sold to the highest bidder without reserve. The sale manager shall have the authority to settle any dispute regarding bidding, and the sale manager’s decision shall be final.

The 2026 Dare to be Different Vol 7 Sale will be hosted on Best Cattle Sales. Bids will be handled confidentially.
